Welcome to LuxHire. These Terms and Conditions govern your use of our website, platform, and services.
By accessing or using LuxHire, you accept and agree to be bound by the terms below.
1. About LuxHire
- LuxHire is a platform that enables employers to discover job seekers. We are not an employment agency and do not guarantee hiring outcomes.
- Services include employer subscriptions and pay-per-CV unlocks, and free profiles for job seekers.
2. Business Customers & NZ Law
Employer subscriptions and CV unlocks are supplied to businesses “in trade”. By subscribing you confirm you are acquiring the services for business purposes.
To the extent permitted by law and subject to section 43 of the Consumer Guarantees Act 1993, the parties agree that the CGA does not apply.
Nothing in these terms limits non-excludable rights under New Zealand law (including the Fair Trading Act 1986).
3. User Responsibilities
- Provide truthful, accurate, and complete information during registration and use; users must be 18+.
- Employers remain solely responsible for all hiring decisions and due-diligence checks, including police/justice checks, right-to-work/visa verification, reference checks, and any legally required medical or fitness-for-work checks (with informed consent and in compliance with the NZ Privacy Act 2020).
- Misrepresentation may result in immediate removal.
4. Accounts, Verification & Suspension
- We may require identity/business verification and may suspend or terminate accounts for breach, misuse, fraud, or legal risk.
- We may remove or restrict content that violates law or our standards.
5. Subscriptions, CV Unlocks & Billing
- Employer membership: NZD $9.99 + GST per month, billed via PayPal. Subscriptions auto-renew monthly until cancelled in your PayPal account. No pro-rata refunds for the current billing period.
- CV unlocks: a CV unlock is supplied when the CV is made available to view/download and is non-refundable after supply.
- All prices are in NZD. Where stated, GST is additional (e.g., the monthly membership is shown as $9.99 + GST).
- Billing disputes or suspected duplicate charges: email support@luxhire.co.nz within 48 hours; see our Refunds & Cancellations for remedies.
- Payments are processed by third-party providers; we do not store full card numbers.
6. Candidate Availability & Lifecycle
- Candidates can keep their profile visible by pressing the “Keep me active” button when logged in. This marks the profile as active for 30 days.
- If a candidate does not press the button for 30 days, their profile becomes inactive and is hidden from employer search.
- If inactivity continues to 60 days, the profile may be deleted. Non-public audit records may be retained to comply with legal or fraud-prevention obligations.
7. Content & Intellectual Property
- You retain ownership of your content. By uploading, you grant LuxHire a non-exclusive, worldwide, royalty-free licence to host, use, display and share your content with verified employers for the purpose of providing the platform.
- You must have the rights to everything you upload and ensure it is lawful, accurate, and not misleading or offensive. Prohibited content includes nudity, sexually explicit content, hate speech, illegal content, and harassment.
- Platform software, branding, and site materials are owned by LuxHire or its licensors.
8. Acceptable Use
- No unlawful activity, harassment, scraping, spamming, malware, or attempts to bypass security.
- No posting of infringing, defamatory, hateful, or sexually explicit material.
9. Availability & Outcomes
We provide access to a platform and tools only. We do not guarantee minimum candidate numbers, suitability, availability, responsiveness, or hiring outcomes.
From time to time the service may be unavailable for maintenance or events outside our control.
10. Liability
To the maximum extent permitted by New Zealand law, LuxHire excludes all implied warranties and limits its aggregate liability to you
for all claims in any 12-month period to the fees you paid to LuxHire in that period (or NZD $100 if you paid no fees).
We do not exclude liability that cannot lawfully be excluded.
11. Refunds & Cancellations
Our refund rules are set out in Refunds & Cancellations.
In short: subscriptions are non-refundable once the billing period starts (you can cancel future renewals);
CV unlocks are non-refundable after supply; verified duplicate/technical billing errors will be credited or refunded.
12. Privacy
Our handling of personal information is described in our Privacy Policy (NZ Privacy Act 2020).
By using the platform you consent to that policy, including overseas processing by our service providers.
13. Termination
- You may stop using the platform at any time; cancellation terms in section 5 apply to subscriptions.
- We may suspend or terminate access for breach, risk, or legal reasons. We may retain data as required by law or for legitimate business purposes.
14. Changes to These Terms
We may amend these terms from time to time. Changes take effect when posted. Continued use means you accept the updated terms.
15. Governing Law
These terms are governed by New Zealand law. New Zealand courts have non-exclusive jurisdiction.
